Mich. woman can sue over toilet paper dispenser

Texas RoadhouseImage via WikipediaA Michigan woman says she can't work or crochet and her bowling game has suffered since her right hand was broken by a toilet paper dispenser in a restaurant bathroom.

The Michigan Supreme Court, in a 4-3 order, has refused to throw out Sheri Schooley's lawsuit against Texas Roadhouse in suburban Detroit. Liberal justices were in the majority in a decision that raises questions about what businesses need to do to protect themselves from liability in strange situations.

Schooley, 58, acknowledged it's a "bizarre story." She and her husband were out for dinner on New Year's Eve 2007 when she visited the restroom.

Texas Roadhouse, Inc. Announces Third Quarter 2010 Results

Results for the quarter included:
  • Comparable restaurant sales increased 4.3% at company restaurants and 4.4% at franchise restaurants;
  • Three company restaurants opened;
  • Restaurant margins increased 79 basis points to 17.9%;
  • Diluted earnings per share increased 28% to $0.19 from $0.15 in the prior year period.

Texas Roadhouse, Inc. Announces Fourth Quarter 2009 Results

Results for the fourth quarter:

•Comparable restaurant sales decreased 2.6% at company restaurants and 1.2% at franchise restaurants;
•Five company restaurants opened and one franchise restaurant was acquired;
•Restaurant margins increased 237 basis points to 17.4%;
•Diluted earnings per share increased 40% to $0.12 from $0.09 in the prior year period.

Results for the quarter included:

•Comparable restaurant sales decreased 4.6% at company-owned restaurants and decreased 3.6% at franchise restaurants;
•One company restaurant and two franchise restaurants opened, while two company restaurants closed;
•Restaurant margins increased 133 basis points;
•Diluted earnings per share increased 27% to $0.15 from $0.12 in the prior year period.

Comparable restaurant sales decreased 1.3% at company-owned restaurants and decreased 1.7% at franchise restaurants;
Nine company restaurants opened;
Restaurant operating costs, as a percentage of restaurant sales, increased 126 basis points;
Diluted earnings per share increased 20% to $0.20 from $0.17 in the prior year period.
